National Do Not Call Registry

Run by the Federal Trade Commission since 2003. Sales calls to registered numbers are not allowed without the consumer’s consent or an existing business relationship.

Scrub at least every 31 days

The FTC Telemarketing Sales Rule requires sellers and telemarketers to check their calling lists against the Registry at least once every 31 days.

TCPA: $500 to $1,500 per call

Under the Telephone Consumer Protection Act (47 U.S.C. § 227), consumers can sue for $500 per violating call, and up to $1,500 when the violation is willful.

FTC penalties over $50,000 per call

The FTC can seek civil penalties of more than $50,000 for each call that violates the Telemarketing Sales Rule.

Calling hours: 8 a.m. to 9 p.m.

Telemarketing calls are only allowed between 8 a.m. and 9 p.m. in the consumer’s local time.

State lists add more rules

Many states keep their own do-not-call lists and stricter calling rules on top of the federal Registry.
